1. Introduction

Welcome to Kins Care, a product of RocketOn LLC. These Terms of Service ("Terms") govern your access and use of our website, mobile applications, and related services (collectively, the "Services"). Kins Care is an all-in-one doula platform enabling doulas to manage clients, create invoices, track mileage, and more. By accessing or using any part of the Services, you agree to be bound by these Terms, our Privacy Policy, and any additional terms and conditions that may apply to specific sections of the Services.

Please note that RocketOn LLC is not a medical or clinical services provider, nor does it employ or supervise doulas. Doulas and other users on Kins Care are independent providers, not employees or agents of RocketOn LLC. If you do not agree with any part of these Terms, please refrain from using the Services.

2. Acceptance of Terms

Please read these Terms carefully. If you do not agree to all the Terms, you should not use the Services. By continuing to use the Services, you acknowledge that you have read and understood these Terms and agree to be legally bound by them. Some features, including but not limited to client portals and enhanced mileage tracking, may be in beta or subject to change, and may have additional guidelines or rules that will apply.

3. Medical Advice Disclaimer

The information provided through Kins Care is for general informational and educational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. We do not provide medical or clinical services, and use of Kins Care does not create a doctor-patient relationship. Always seek the advice of a qualified health provider with any questions you may have regarding a medical condition.

Doulas using the platform are solely responsible for the advice and care they offer to their clients. Kins Care does not supervise or control the services that doulas provide, and does not assume liability for their actions or omissions.

4. Eligibility & Account Registration

To use Kins Care, you must be at least 18 years old or have legal parental/guardian consent. You agree to provide accurate, current, and complete information when you register for an account, and to update such information if it changes. You are responsible for maintaining the confidentiality of your account credentials and for any activities under your account.

If you are a doula, you represent and warrant that you have the necessary qualifications, certifications, or experience required by law or regulation to provide doula or birth support services in your jurisdiction. You acknowledge that RocketOn LLC does not verify these qualifications.

5. User Responsibilities & Acceptable Use

You agree not to:

  • Use the Services for any unlawful or prohibited purpose.
  • Submit false or misleading information.
  • Harvest or collect personal information of other users without consent.
  • Engage in any activity that disrupts or interferes with the functioning of the Services.
  • Upload or transmit viruses or other harmful code.
  • Attempt to gain unauthorized access to our systems or networks.

You are solely responsible for complying with all applicable laws, regulations, and professional standards, including those relating to client privacy, data protection, and professional conduct.

6. Payments & Subscriptions

Some features of Kins Care may require a subscription or one-time payment. By purchasing, you agree to provide valid payment details and authorize us to charge applicable fees. Subscription plans may auto-renew unless canceled prior to the renewal date. You are responsible for all fees associated with your chosen plan. If Kins Care integrates with third-party payment processors, you may also be subject to the terms and conditions of those payment services.

If you charge your own clients through Kins Care, you acknowledge that RocketOn LLC is not a party to the transaction between you and your client and shall have no liability for any disputes, refunds, or chargebacks beyond what is stated in these Terms or required by law.

7. Refunds & Cancellations

Payments for subscriptions or services are generally non-refundable. However, refunds may be issued at our discretion in extraordinary circumstances. If you wish to request a refund or cancel your subscription, please contact us at hello@kins.care.

In the event of a dispute between a doula and a client relating to fees or services, RocketOn LLC is not responsible for mediating or resolving the dispute, and any refunds or adjustments are at the sole discretion of the doula, unless otherwise required by law.

8. Third-Party Websites & Content

Our Services may contain links to third-party websites or resources that are not owned or controlled by RocketOn LLC. We do not endorse or assume any responsibility for any such third-party sites, information, materials, or services. If you access a third-party website from our Services, you do so at your own risk, and you understand that these Terms do not apply to your use of such sites.

9. Intellectual Property

All content, features, and functionality on Kins Care, including text, graphics, logos, icons, images, videos, and software, are the property of RocketOn LLC or its licensors and are protected by intellectual property laws. You may not reproduce, distribute, or otherwise exploit any of the content without express written permission.

Any content or data you upload or submit to the Services (e.g., client information, contracts, or notes) remains your property. However, by uploading content, you grant RocketOn LLC a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display such content solely for the purpose of providing the Services. You represent and warrant that you have all necessary rights to grant this license.

10. Health & Wellness Disclaimer

Kins Care does not provide clinical or medical services. Any health and wellness information provided is intended for general knowledge and is not a substitute for professional medical advice. Always consult a qualified health professional for personalized guidance regarding your health.

11. Indemnification

You agree to indemnify, defend, and hold harmless RocketOn LLC and its affiliates, officers, directors, employees, agents, and partners from and against any claims, liabilities, damages, losses, or expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your access to or use of the Services, or your violation of these Terms.

12. Limitation of Liability

To the fullest extent permitted by law, RocketOn LLC and its affiliates shall not be liable for any direct, indirect, incidental, consequential, or exemplary damages resulting from your use of, or inability to use, the Services, or for the cost of procurement of substitute goods or services. This limitation applies regardless of the legal theory on which the claim is based.

13. Termination

We reserve the right to suspend or terminate your access to the Services at any time, for any or no reason, including violation of these Terms. Upon termination, your right to use the Services will immediately cease.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any dispute arising out of or related to these Terms shall be brought exclusively in the courts located in Los Angeles County, California.

15. Changes to Terms

RocketOn LLC may modify these Terms from time to time. If we make material changes, we will provide notice through the Services or by other means. Your continued use of the Services after such modifications indicates your acceptance of the new Terms.
